Terms of Service
Last updated: 17 October 2026
These Terms of Service govern your use of the Vintdragon website and the services provided by Vintdragon. By engaging our services, approving a proposal or placing an order, you agree to these terms, together with any specific terms agreed in writing for your project.
Please read these terms carefully before purchasing or using our services.
1. About Vintdragon
Vintdragon is a web design and digital services business operated by a sole trader.
- Trading name: Vintdragon
- Legal name: Thomas William Lewis

- Website: https://vintdragon.com
References to “we”, “us” or “our” in these terms mean the sole trader operating Vintdragon. References to “you” or “your” mean the individual or business purchasing or using our services.
2. Our Services
Vintdragon provides website design, website development and other digital services as agreed with each client.
The precise services provided will depend on your requirements and the scope agreed before work begins. Services may include, where expressly agreed:
- Website design and redesign.
- Website development and implementation.
- Website content and layout assistance.
- Website integrations and third-party tools.
- Website maintenance and ongoing support.
- Other digital services specified in a written proposal or agreement.
Not every service is included in every project. Any deliverables, features, integrations, revisions, deadlines or ongoing services will be set out in the relevant proposal, quotation, order or written agreement.
We reserve the right to decline work where appropriate.
3. Quotes, Pricing and Payment
Pricing
Vintdragon does not operate a universal fixed price list for projects. Pricing depends on the specific website, services, functionality, complexity, requirements and scope requested by the client.
We will provide a quote or proposal based on the agreed requirements. Unless stated otherwise in writing, a quote applies only to the scope described in it.
If you request additional features, significant changes or work outside the agreed scope, we may provide a revised quote or charge an additional fee. We will communicate material changes to the price before undertaking the additional work.
Payment Terms
Payment amounts, due dates, deposits, instalments and any recurring fees will be specified in your quote, proposal, invoice or written agreement.
Payments may be processed through Stripe or another payment provider agreed by Vintdragon. Payment processing may be subject to the provider's own terms and privacy policy.
You are responsible for providing accurate payment and billing information and paying amounts due by the agreed deadlines.
Where an invoice remains unpaid, we may suspend work, withhold delivery or restrict access to relevant services after giving any notice required by the agreement or applicable law. We will not use this provision to remove or restrict rights that you have under applicable consumer law.
Any applicable taxes, including VAT if chargeable, will be identified as required by law.
4. Project Scope and Revisions
The agreed project scope will be based on the quote, proposal or other written agreement accepted by both parties.
You must review deliverables and provide feedback, approvals, content and other requested information within a reasonable time.
The number of revisions included, where applicable, will be specified in the relevant agreement. Requests outside the agreed scope, or revisions arising from a change in your original requirements, may incur additional charges.
We will explain any material additional costs and obtain your agreement before proceeding with chargeable extra work.
5. Your Responsibilities
To enable us to deliver the services, you agree to:
- Provide accurate information and clear instructions.
- Supply required text, images, branding, credentials and other materials in a timely manner.
- Ensure you have the necessary rights and permissions to use materials you provide.
- Review designs, content and deliverables and provide feedback within reasonable timeframes.
- Ensure that your instructions, supplied content and intended use of the website comply with applicable law.
- Pay agreed fees when due.
- Keep account credentials and access details secure and use appropriate access permissions.
Delays caused by missing information, late approvals, incomplete materials or other matters within your control may affect project deadlines. We will communicate material delays where reasonably practicable.
6. Project Timelines and Delivery
Any project timeline or estimated completion date will be communicated in the relevant proposal or written agreement.
Unless expressly agreed otherwise, timelines are estimates and depend on timely cooperation, approvals, payments and the availability of necessary third-party services.
We will make reasonable efforts to deliver the agreed work within the stated timeframe. We are not responsible for delays caused by circumstances outside our reasonable control, including client delays, third-party outages or events covered by the force majeure provisions below.
7. Intellectual Property
Materials You Provide
You retain ownership of materials you own and provide to us, including your branding, text, photographs and other content.
You grant us permission to use those materials as reasonably necessary to perform the agreed services.
You are responsible for ensuring that you have the rights and permissions required for materials you provide.
Work Created for You
Ownership of custom designs, code, content and other deliverables created for your project will be governed by the relevant written agreement.
Unless otherwise agreed in writing, and subject to full payment of all amounts due, we grant you the rights necessary to use the final deliverables for their agreed purpose. Any transfer or assignment of intellectual property ownership must be expressly agreed in writing.
We retain ownership of our pre-existing materials, reusable components, tools, processes, templates, know-how and other materials that are not exclusively created for you. Where these are incorporated into a deliverable, we grant you the rights reasonably necessary to use that deliverable for its intended purpose, subject to any applicable third-party licence terms.
Third-Party Materials
Fonts, stock images, plugins, themes, software, libraries and other third-party materials may be subject to separate licences and terms. You must comply with those terms where they apply to your use of the deliverables.
8. Website Hosting, Domains and Third-Party Services
Your project may rely on third-party services, such as hosting providers, domain registrars, payment processors, booking systems, plugins, software platforms or external APIs.
Unless expressly included in the agreed scope, third-party subscriptions, domain registration, hosting, premium licences and other external charges are not included in our project fees.
Third-party services are subject to their own terms, pricing, availability and policies. We do not control those services and cannot guarantee their uninterrupted operation or continued availability.
Where we configure or assist with a third-party service, you remain responsible for any account, subscription or renewal assigned to you, unless we expressly agree otherwise in writing.
9. Maintenance and Ongoing Support
Website maintenance, updates, security monitoring, backups, hosting management and ongoing support are not automatically included in a website design or development project.
Any maintenance or support arrangement must be agreed separately in writing, including its scope, fees, response expectations and duration.
Where no separate maintenance agreement exists, we are not obliged to provide ongoing updates, support or changes after the agreed project has been completed, except where required by law or the original agreement.
10. Website Performance and Business Results
We aim to deliver services with reasonable care and skill and in accordance with the agreed scope.
However, we do not guarantee specific business outcomes, including:
- Search engine rankings or a particular position in search results.
- A particular level of website traffic or enquiries.
- Sales, revenue, leads or conversion rates.
- Advertising performance or return on investment.
- The uninterrupted availability of third-party platforms.
- The achievement of any particular commercial objective.
Website performance can depend on factors outside our control, including market conditions, competition, search engine algorithms, client content, hosting infrastructure and third-party services.
Nothing in these terms excludes any guarantee, right or remedy that cannot lawfully be excluded.
11. Acceptable Use
You must not use our website or services for unlawful, fraudulent, deceptive, harmful or infringing activities.
You must not attempt to gain unauthorised access to our systems, interfere with our website's operation, distribute malicious software or misuse our services in a way that could cause harm to others.
We may take reasonable steps to protect our business, website and systems where we reasonably believe these terms have been breached, subject to applicable law and any contractual obligations.
12. Confidentiality
Both parties should take reasonable care to protect confidential information disclosed in connection with a project.
Confidential information must not be disclosed to others except where disclosure is authorised, reasonably necessary to perform the agreement, required by law or otherwise permitted by the relevant written agreement.
Where a separate non-disclosure agreement or confidentiality agreement applies, its terms will also govern the relevant information.
13. Cancellations, Refunds and Consumer Rights
Cancellation rights and refund arrangements depend on the nature of the agreement, the stage of the project and whether you are purchasing as a consumer or as a business.
Business Clients
For business clients, cancellation, payment for completed work, committed costs and any applicable notice period will be governed by the relevant proposal or written agreement and applicable law.
Where no specific cancellation terms have been agreed, we will discuss the position with you and account for work already performed and any reasonable, properly incurred commitments, subject to the agreement and applicable law.
Consumers
If you are a consumer entering into a contract online or at a distance, you may have a statutory right to cancel within 14 days of entering into the contract, subject to the applicable legal requirements and exceptions.
If you ask us to begin providing services during that cancellation period, additional rules may apply. You may be required to pay a proportionate amount for services already supplied before cancellation where the law permits. Your right to cancel may be affected where a service has been fully performed following your express request and acknowledgement of the relevant legal consequences.
We will provide any cancellation information, required notices and request for early commencement where legally required.
Nothing in these terms limits or excludes your statutory consumer rights. If these terms conflict with a mandatory legal right, that legal right will prevail.
14. Suspension or Termination
Either party may terminate a project or ongoing arrangement where permitted by the relevant written agreement or applicable law.
Where a party materially breaches an agreement, the other party may give written notice requesting that the breach be remedied within a reasonable period, where appropriate. If the breach is not remedied, the affected party may exercise any termination rights available under the agreement or law.
We may suspend work for overdue payments or serious misuse of our services, subject to the agreement, applicable law and any required notice.
On termination, the parties will settle outstanding amounts and address the treatment of completed work, project files, access credentials and intellectual property in accordance with the agreement and applicable law.
15. Limitation of Liability
We will be responsible for losses where required under applicable law and the terms of our agreement.
To the fullest extent permitted by law, we are not liable for indirect or consequential losses, loss of profits, loss of anticipated savings, loss of business opportunities or loss of data arising from the use of our services, except where such liability cannot lawfully be excluded.
We are not responsible for failures or losses caused by inaccurate information or materials supplied by you, unauthorised changes made by others, or third-party services outside our reasonable control, except where applicable law provides otherwise.
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.
Where you are a consumer, these terms do not affect your statutory rights or any liability that cannot lawfully be restricted.
16. Events Outside Our Control
We are not responsible for delays or failures caused by events outside our reasonable control, including natural disasters, serious service outages, government action, industrial disputes, widespread internet failures or other comparable events.
We will take reasonable steps to minimise the effects of such events and resume performance when reasonably practicable.
This clause does not remove any rights you may have under applicable law.
17. Privacy and Personal Information
We handle personal information in accordance with our Privacy Policy, available on the Vintdragon website.
Our Privacy Policy explains what information we collect, how we use it, the service providers involved and the rights available to individuals under applicable data protection law.
Where we process personal information on behalf of a client as part of a project, additional contractual data protection terms may be required depending on the services and circumstances.
18. Changes to These Terms
We may update these terms to reflect changes to our business, services or legal obligations.
The latest version will be published on our website with an updated date. Changes will not retrospectively alter an existing agreement where doing so would be unlawful or contrary to the agreed contract.
Where a change materially affects an ongoing service, we will provide notice where required by the agreement or applicable law.
19. Governing Law
These terms are governed by the laws of England and Wales, except where mandatory consumer protection laws require otherwise.
The courts of England and Wales will have jurisdiction over disputes, subject to any mandatory rights you may have to bring proceedings in another jurisdiction.
